ITC Issues Exclusion Orders Against CORE Flash™ Portfolio Infringers

CORE Flash Licensee Community Benefits from Aggressive Enforcement Campaigns

CUPERTINO, California – March 18, 2013 – Alliacense today announced that the US

International Trade Commission (ITC) has issued a limited exclusion order, and cease

and desist orders, directed against infringing products of respondents Nextar Inc. of La

Verne, California, WinAccord Ltd. of Taipei, Taiwan and WinAccord USA, Inc. of San

Jose, California, Aiptek International Inc. of Hsinchu, Taiwan, and Pandigital, Inc. of

Dublin, California.

 

The ITC instituted its investigation on September 27, 2011, based on a complaint filed by

Technology Properties Limited, LLC (‘‘TPL’’) of Cupertino, California. The complaint

alleged a violation of Section 337 of the Tariff Act in the importation into the US, the sale

for importation, and the sale within the US after importation of certain digital photo frames

and image display devices and components thereof by reason of infringement of certain

claims of its CORE Flash Portfolio technology.

 

The Commission’s notice of investigation named 20 respondents including: Nextar,

WinAccord, Aiptek, Pandigital, Action Electronics, Aluratek, Audiovox, CEIVA Logic,

Circus World Displays, Coby Electronics Corporation, Curtis International, Digital

Spectrum Solutions, Inc., Eastman Kodak Company, Mustek Systems, Inc., Royal

Consumer Information Products, Inc., Sony Corporation, Transcend Information, Inc., and

Viewsonic Corporation.

 

Several of the respondents purchased CORE Flash license agreements during the

investigation, including: Coby, Aluratek, Circus World Displays, Curtis, Royal Consumer,

Viewsonic, CEIVA, Audiovox.

 

Infringement actions, seeking damages and injunctions remain on going in the US District

Court for the Eastern District of Texas against Eastman Kodak, Mustek, Digital Spectrum

Solutions, Action Electronics, Transcend and Sony.
